Our Law Firm Acts in Anti-Dumping Proceedings Before the European Commission

Our law firm’s team, led by attorney Marcin Kręglewski (partner) and attorney Magdalena Napierała (senior counsel, attorney), is representing a client in ongoing anti-dumping proceedings before the European Commission (case no. AD733) concerning imports of tires from China.

Scope of the Case: PCR Tires Under Investigation

Proceedings AD733 concern imports into the European Union of new pneumatic tires made of rubber, intended for passenger cars, buses, and trucks, with a load index not exceeding 121 – so-called PCR tires. If dumping practices are confirmed, the Commission may impose anti-dumping duties of up to several dozen, and in extreme cases several hundred, percent of the value of the goods.

At this stage, the Commission is hearing the views and arguments of interested parties, including independent importers operating in the European Union, for whom the introduction of duties will mean higher prices or even a reduction in the range of products they offer.

Our Client’s Perspective: Niche Tires Should Be Excluded

Our client is an independent importer specializing in niche market segments, including:

  • spare tires (space-saver tires),
  • tires for trailers and tow trucks with a diameter of up to 15 inches.

In our client’s opinion, the above products should not be subject to anti-dumping duties because:

  • such tires are not readily available for sale in the European Union to distributors or wholesalers,
  • their import does not cause significant damage to the EU industry,
  • and subjecting them to proceedings would be disproportionate and would affect SMEs as well as retail customers.

Meeting with the European Commission: Legal and Business Arguments Presented

On June 23, 2025, at the request of our law firm, an explanatory meeting was held
with representatives of the European Commission from the Injury Team, our client, and lawyers from our law firm.

At the meeting, legal and business arguments were presented in favor of excluding the types of tires proposed by the client from the anti-dumping investigation.

The European Commission is considering the possibility of imposing provisional duties by December 21, 2025. However, definitive anti-dumping duties may be imposed by June 19, 2026, at the latest.

Broader Implications for the SME Import Sector

The results of the European Commission’s investigation into AD733 may have negative consequences for many importers in the SME sector, who are threatened by the broad scope of the products covered by the proceedings.
