Training for “Rzeczpospolita” on Trade in Strategic Goods
Michał Dudkowiak, Michał Puk, Ignacy Heckert, Wiktor Galusiński, Daria Piwecka, and Aleksandra Jakubowska delivered a training session for participants of an event organized by “Rzeczpospolita”, focused on the legal obligations of businesses involved in the trade of strategic goods, including dual-use items and military equipment.
The training addressed the growing regulatory challenges driven by geopolitical developments, which increasingly affect not only the defense sector but also technology, manufacturing, and export-oriented companies. In practice, even minor errors – such as incorrect classification or failure to obtain the required authorization – may result in serious consequences, including financial penalties or criminal liability.
The session focused on the practical application of regulations, in particular:
-classification of goods as dual-use, military, or controlled items,
-licensing requirements and risks associated with non-compliance,
-application of the catch-all clause and assessment of end-use and end-user,
-implementation and operation of Internal Compliance Programs (ICP),
-documentation and record-keeping obligations,
-preparation for administrative and customs inspections,
-administrative and criminal liability risks.
An important part of the training was the discussion of real-life scenarios, including case studies related to UAV (drone) technologies, covering transfers, testing, servicing, and intangible technology transfers such as software sharing.
