LANDING Dual-Use Goods and Strategic Goods Compliance Training in Poland

Dudkowiak & Putyra provides practical legal training for companies dealing with dual-use goods, strategic goods, military-related products, controlled technologies, software, components and cross-border transactions.

The training is designed for businesses that need to understand when their products, services or transactions may fall under EU and Polish export control regulations, including rules on classification, export licences, Polish concessions, Internal Compliance Programs, customs inspections and liability.

The programme is especially relevant for exporters, manufacturers, technology companies, defence suppliers, logistics operators and companies entering the Polish defence or strategic goods market. D&P materials identify dual-use regulation, strategic goods controls, defence concessions, export licences and compliance programmes as key legal areas for companies operating in this sector.

Dual-Use Goods Classification and Strategic Goods Assessment

The training explains how to assess whether goods, software, technology, components or know-how may be classified as dual-use goods or strategic goods.

Participants learn how to approach:

  • dual-use classification under EU Regulation 2021/821,
  • military goods and armaments-related controls,
  • technical parameters and control lists,
  • software, technology and know-how transfers,
  • end-use and end-user assessment,
  • catch-all risk,
  • documentation of classification decisions.

Check the video below, where Wiktor Galusiński explains what dual-use goods are and why seemingly civilian products may be stopped at the border under EU export control rules. Learn how EU Regulation 2021/821 can affect exports from Poland and why proper product classification is essential before shipping.

Training Programme

The training programme is structured as a practical one-day course covering the key legal, regulatory and operational risks related to dual-use goods, strategic goods, armaments, export controls and internal compliance procedures. It is based on real issues faced by companies involved in export, logistics, technology transfer, servicing, brokering and defence-related transactions.

1. Dual-Use Goods, Armaments and Strategic Goods in Practice

Participants are introduced to the legal framework governing dual-use goods, armaments and strategic goods, including the differences between controlled product categories, concession-based activity and regulated transactions such as export, transfer, transit, brokering and technical assistance.

2. Product and Transaction Classification

This module explains how to classify goods, software, technologies and transactions, with focus on technical parameters, control lists, military or dual-use qualification, and common mistakes that may trigger licensing or regulatory risks.

3. Export Authorisations, Concessions and Catch-All Risk

The training covers when export licences, Polish concessions or other authorisations may be required, including situations where a product is not clearly listed but may still be controlled due to end-use, end-user, destination or security concerns.

4. UAV and Technology Case Study

A practical case study based on drones and UAV-related activities shows how dual-use risks may arise in testing, demonstrations, servicing, repairs, returns, software updates, intra-group transfers and other routine business operations.

5. Internal Compliance Program / ICP / WSK Documentation

Participants learn how to build and document an effective internal compliance process, including classification notes, responsibility structure, counterparty and end-user verification, escalation procedures, record-keeping and archiving of compliance decisions.

6. Customs Controls, Administrative Inspections and Enforcement

This part focuses on inspections, customs controls and authority requests, including blocked shipments, documentation gaps, first-response mistakes, administrative decisions and sanctions.

7. Criminal Liability and Compliance Defence

The final module covers liability risks for the organisation, management board members and operational staff, including typical scenarios such as incorrect classification, trading without required authorisation, breach of licence conditions or attempts to circumvent restrictions.

Export Controls, Licences and Polish Concessions

The programme covers key authorisation requirements that may apply before exporting, transferring, brokering, servicing or handling controlled products.

Topics include:

  • dual-use export authorisations,
  • individual, global and general licences,
  • intra-EU transfer controls,
  • brokering and technical assistance,
  • Polish concessions for defence-related activities,
  • end-user certificates and import certificates,
  • common reasons for delays or authority questions.

If you are wondering whether your business activity in Poland requires a license or concession, start with this short video guide below. It provides a clear overview of the key rules before you move to more detailed legal analysis.

Internal Compliance Program / ICP / WSK

A separate part of the training focuses on internal procedures for managing strategic trade and export control risks.

Participants learn what should be included in an effective Internal Compliance Program, ICP or WSK, including:

  • responsibility structure,
  • product classification workflow,
  • transaction risk assessment,
  • sanctions screening,
  • customer and end-user verification,
  • contract and shipment review,
  • record-keeping,
  • internal escalation and employee training.

Customs Inspections, Enforcement and Liability

The training also explains practical risks connected with customs controls, inspections and enforcement proceedings.

Participants learn:

  • what may happen when customs stops a shipment,
  • what documents authorities may request,
  • how classification errors are identified,
  • which red flags increase regulatory risk,
  • when administrative or criminal liability may arise,
  • how internal documentation may support the company during inspection.

The training is recommended for:

  • management board members,
  • compliance officers,
  • in-house lawyers,
  • export, sales and logistics teams,
  • customs and procurement departments,
