Compulsory property regime

If you live separately with your spouse, you do not have a common household and you plan to get a divorce, you have right to demand establishment of compulsory property separation during the marriage. You should keep in mind that even if you break up and move out form joint apartment, almost everything you earn and buy until the final divorce become a joint marital property. In accordance with the Family and Guardianship Code, the court may, for important reasons, establish property separation between the spouses during the marriage. Property separation may also be established by the court with a retrospective date. A petition for the establishment of compulsory property separation may be filed by the spouse, the creditor of one of the spouses and the public prosecutor.
