European Commission’s brochure – new obligations of payment services providers

Since January 1st, 2022 each Polish payment services provider operating on the B2C market will be obliged to make available to consumers the information brochure of the European Commission concerning the rights of consumers related to making payment in EU member states.

These new provisions of the Polish Payment Services Act constitute the implementation of Art. 106 PSD2 Directive (Directive 2015/2366). The brochure in questions will have to be made available to consumers:

  1. on the website of the payment services provider (with the option for printing the brochure),
  2. in paper form in each location where a given payment services provider (its branch, agent, intermediary) concludes agreements for the provision of payment services with the simultaneous physical presence of the parties,
  3. in a manner convenient for people with disabilities [which may imply additional measures different from the ad (i)-(ii) above].
