The NBP inspired statutory guarantee of cash payments acceptance now submitted to the Polish Parliament

Polish President Andrzej Duda submitted to Sejm (the lower chamber of Polish Parliament) a draft novel to the Payment Services Act which we analyzed and briefed not so long ago. The draft novel includes NBP inspired changes concerning the compulsory acceptance of cash by merchants / professional vendors, which are materialized in projected art. 59ea Payment Services Act. According to that article, merchants shall not: (i) conclude of a B2C contract conditional on cashless payment and, (ii) refuse to accept payment in B2C relation with Polish currency, (iii) charge any additional fees for accepting payment in B2C relation with Polish currency, (iv) differentiate the price depending on payment method.
