PPK – who will be obliged to join the programme from January 2020?
From January 1, 2020, medium-sized enterprises will be covered by the scheme. Companies employing from 50 people and above will have to work hard to implement their employee capital plans (PPK). It will be so much simpler for them that they can benefit from the experience of the largest entities.
January 1, 2020 the PPK will cover entities which as of June 30, 2019 employed between 50 and 249 persons.
Attention: deliberately employed persons are not referred to as employees here. All persons employed on the basis mentioned in the Act can be enrolled in the PPK as they are entitled to pay compulsory social security contributions by the employer (thus it is not only about employment contracts).
An entrepreneur should carefully assess the number of employed persons within the meaning of the Act. Underestimation of this amount and late implementation of the PSC may result in criminal liability of the employer.
The PPK implementation procedure can take up to several months, so medium enterprises should start preparations as soon as possible. Unlike the 2019 implementation procedure, the 2020 implementation should already be more efficient. This is due to the fact that the Polish Development Fund has issued a number of interpretations concerning questionable issues, which are updated on a regular basis. Additionally, advisors and financial institutions have gained practice in this area. In addition, average employers can also benefit from numerous experiences gained during implementations in large companies.
