Bankruptcy of Cinkciarz.pl – filing claims after the deadline

The District Court in Zielona Góra declared the bankruptcy of the online currency exchange Cinkciarz.pl Sp. z o.o. on Monday, October 27, 2025. According to the announcement, creditors had 30 days to file their claims. This means that November 26, 2025, was the deadline for filing claims. Creditors who did not meet the deadline may feel that they have been deprived of this opportunity.

However, the expiry of the 30-day period does not mean that the door to receivable is closed. Law of bankruptcy does provide for the possibility of filing claims after the deadline. However, it should be remembered that late filing has certain consequences. In order to successfully file a claim after the deadline, the creditor must pay a flat-rate fee for the bankruptcy proceedings, even if the delay was not their fault.

In 2025, the flat-rate costs of bankruptcy proceedings amount to PLN 1,239.95, which is equivalent to approximately EUR 292.50 or approximately USD 339.60.

Despite the additional costs, filing a claim after the deadline may still be beneficial, as failure to do so prevents the creditor from participating in the distribution of funds obtained from the bankruptcy. However, it should be noted that claims filed after the deadline do not affect the plans for the distribution of assets from the bankruptcy estate that have already been submitted. If the distribution plan has already been prepared, claims filed after its preparation will only be taken into account if further distribution plans are drawn up.

Furthermore, claims filed after the final distribution plan for the bankruptcy estate has been approved can no longer be considered.

It is not worth delaying the filing of a claim

While it is still possible to file a claim after the deadline, it should be noted that late action may be ineffective due to the prior approval of the distribution plan.

The deadline for filing claims in the Cinkciarza case has recently expired, meaning that the distribution plan has not yet been drawn up- this is the last chance for late creditors to be included in it.
