End of work on amendments to the Polish Labor Code – new law to be signed by the President

Remote work and sobriety control

The new law assume the introduction of regulations on remote work to the Polish Labor Code. Outdated provisions on telework will be removed from the Labor Code, and completely new regulations on remote work will be introduced, adapted to today’s reality on the labor market. The Labor Code will include i.a. occasional remote work and remote work at the employee’s request.

Provisions on control of employees’ sobriety will also be introduced to the Labor Code. Employers will be able to control the sobriety of employees without having to call the police, using methods that do not require laboratory testing (e.g. breathalyser).

When to expect changes?

Pursuant to the act amending the Labor Code, the provisions on sobriety control are to come into force 2 weeks after the act is announced. Which means that we can expect their entry into force most likely in February 2023.

A slightly longer waiting period for entry into force has been provided for the provisions on remote work. The new chapter on remote work is to apply after 2 months from the announcement of the act, which means that we can expect its entry into force between March and April 2023.

Employers on standby

Employers who want to be able to control the sobriety of employees should start preparing for the changes now, so as to be prepared for the implementation of the new regulations on the day they enter into force. Implementation of the sobriety control will require, among others, regulating the rules of its conduct in the work regulations and notifying the employees about the intention to carry out controls.

The new regulations on remote work will make it necessary to introduce changes to the work regulations, the content of employment contracts and applications for employees. Employers who employ or want to employ employees remotely should also start preparing for the upcoming changes now.
