What will change in the Polish law in 2026?

Tax changes in 2026: KSeF and new obligations for entrepreneurs are coming
From February 2026 for large companies, and from April for the rest, the mandatory central e-invoicing system KSeF will come into force. This is a fundamental operational change for every company, so it is worth preparing for it well in advance.

Employment law 2026: gender pay gap, new obligations, and reclassification of B2B contracts
Poland will introduce mandatory disclosure of gender pay gaps, both to employees and in reports submitted to state authorities. This means that now is the last moment to consider implementing salary restructuring plans.
In addition, the National Labor Inspectorate is expected to gain new powers allowing it to reclassify civil law agreements or B2B contracts as employment relationships. Companies using such forms of cooperation, especially in the IT sector, should analyze the risks and possibly prepare for a transition to full-time employment.
Company law 2026: new control rules and risk classification for companies
From 2026, business and regulatory controls will be carried out according to new rules. Supervisory authorities will develop periodic risk-based control plans, assigning companies to low, medium, or high risk categories. The frequency of controls will depend on this classification. Companies operating in accordance with the regulations can expect fewer inspections, while repeat offenders will face increased supervision.

Corporate law 2026: digital communication, e-powers of attorney, and new JSA obligations
The amendment to the Commercial Companies Code will simplify, among other things, electronic communication between the company and its shareholders, and will also enable simple electronic powers of attorney to participate in shareholders’ meetings. In addition, joint-stock companies will be required to disclose who keeps the register of shareholders in order to increase corporate transparency.
Court and enforcement proceedings 2026- e-powers of attorney and online auctions as standard
From March 2026, electronic powers of attorney will be recognized in courts, and from December, online auctions will become the default form of bidding in enforcement proceedings.
