Vehicle charging stations at major companies mandatory as early as January 1, 2025
Amendments to the Act on Electromobility and Alternative Fuels introduce new obligations for large businesses in Poland, which will have to install electric vehicle charging points in their non-residential buildings.
New responsibilities of charging station installation – What do you need to know?
According to the amendment, as of January 1, 2025, in non-residential buildings with more than 20 parking spaces owned by large businesses, the owner, or manager will be required to install at least one charging point.
In addition, it will be necessary to prepare conduits for electrical wires and cables to allow the installation of charging points for at least 1 in 5 parking stalls. This obligation applies to both parking stalls located inside the building and those adjacent to the building.
The important thing is that by adjacent to a building is meant the connection to the building in terms of ownership or use under another legal title. The parking lot must be directly adjacent to the building or functionally related to it, even if it is not directly adjacent to the building.
Newly constructed facilities – What requirements must they meet?
For newly constructed non-residential buildings that will have at least 11 parking spaces, developers will have to design and build the facility to provide:
- Installation of at least one charging point,
- Ducts for electrical wires and cables to allow the installation of charging points for at least one of the five parking spaces.
Who is affected by the obligation to install charging stations?
These obligations apply only to large entrepreneurs. Small and medium-sized entrepreneurs are exempt from these requirements to avoid overburdening smaller businesses, which may not have the same resources as large companies.
According to the Entrepreneurs’ Law, a large entrepreneur is an entity that in at least one of the last two fiscal years:
- Employed an average of at least 250 employees per year, or
- Achieved an annual net turnover from sales of goods, products and services and financial operations exceeding the PLN equivalent of 50 million, or the total assets of its balance sheet drawn up at the end of one of these years exceeded the PLN equivalent of 43 million.
What do the changes mean for entrepreneurs?
An amendment to the Law on Electromobility and Alternative Fuels introduces new requirements for large entrepreneurs to accelerate the development of electric vehicle charging infrastructure.
The exclusion of small and medium-sized entrepreneurs from these obligations ensures that the development of electromobility will be carried out in a balanced way that takes into account the different capabilities of economic players.
