The amendment to the Polish Labor Code is already in the Journal of Laws
The process of amending the Polish Labor Code introducing sobriety control and remote work has officially come to an end. Recently, we reported that work on amending the Labor Code was completed and the new law was submitted for President’s signature. However, we are back with the latest information: the President signed the act in January and on February 6, 2023, the act was published in the Journal of Laws.
Entry into force of the changes
According to what was included in the draft act, the new law in its final form provides for different vacatio legis for sobriety control and remote work. The provisions on sobriety control will come into force sooner, only 14 days after the publication of the act. We will wait a bit longer for the provisions on remote work – the waiting time for entry into force is 2 months from publication. The extended waiting period for remote work is to allow employers to prepare for the changes.
When exactly are the new regulations?
According to the vacatio legis periods indicated above:
– the provisions on sobriety control will come into force on February 21, 2023;
– the provisions on remote work will come into force on April 7, 2023.
Last moments for change
Employers who want to introduce sobriety control in their workplaces should already be prepared for the upcoming changes. Employers who hire employees remotely also have little time to adapt to the new regulations – especially considering the amount of internal documentation that needs to be prepared.
